This privacy notice explains how we use any personal information we collect about you (service users and employed staff), during the information gathering processes known as Recruitment and Selection, Induction, and also our Initial Assessment of Need. All data storage and retention is reviewed annually alongside our NHS Digital Toolkit.

What information do we need to collect about you?

The nature of the care service we provide means that very personal and sensitive information is shared during discussions with both employed staff and service users. This is openly and honestly, to ensure we can meet service users health and social care needs in ways that are unique to individual circumstances. 

The specific type of information is required in order for us to meet our legal and regulatory obligations as a registered care provider.

The Lawful Bases which we, Shield Health and Social Care use are contained within under the Data Protection Act 2018 and Under the General Data Protection Regulation (GDPR), are:

  1. Your consentconsent can be removed at any time by contacting the Registered Manager.
  2. We have a contractual obligation with yourself and/ or Adult Social Care.
  3. We have a legal obligation.
  4. We have a vital interest.
  5. We have a legitimate interest

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How information about you will be used

We may share information regarding your health and care needs with those who have a need to know, namely Health Professionals, such as GP’s, District Nurses, Hospitals etc., Local Authorities, includes departments such as Adult Social Care, Social Services, Housing, Day Center’s etc. Any relevant person identified by you, such as an L.P.A., and our care staff. 

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

How will we use this information

Upon completion of your Assessment of Need, we compile a Person-Centered Care and Support Plan which sets out tasks, aspirations, and outcomes in order to meet all your identified needs and this is regularly reviewed and updated.  This includes liaison with all those involved in your care such as close family members, your representative relevant health and social care colleagues and other professionals.

Access to your information and correction of information

All files held in your name are available for you to access upon request and you can ask us to remove or change any information at any time which is inaccurate.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to your request.

How we store your personal information

Your information we hold in the office is stored in a secure locked cabinet. Access for this information is for senior staff responsible for the upkeep of your information.

We keep all personal information for three years in a secure area of the office (archive area) this is then disposed of using the ‘Shred it’ service and or by our office staff using the office allocated shred machine, when this is used all shredding will be carried out on site.

All information stored on the computer (hard copies) are held on a hard drive which is secure, and password protected. We routinely back up the hard drive and this is done on a routine basis by the registered manager and or a nominated senior office staff.

Data on the computer will be held for three years as we do with paper copies this is then taken off the hard drive by the registered manager and or the nominated senior office staff.
